CLIENT-COACH AGREEMENT
This Agreement sets out the terms under which coaching services are provided by Triforia, the trading name of Alex Birch, a sole trader, and/or any coach authorised by Triforia to provide coaching services on its behalf (the "Coach"), to the individual named at the end of this document (the "Client"). Coaching Services means endurance coaching services provided by Triforia, which may include one or more of the following, as selected by the Client: triathlon, running, cycling and/or swimming. This Agreement is intended to clearly define responsibilities, manage risk appropriately, and set expectations for both parties.
1. Your Coach’s commitment to you
1.1 Professional Services
Using professional judgement, experience and qualifications, the Coach will design and deliver a personalised coaching programme appropriate to the Client’s goals, fitness level, experience, preferences and disclosed limitations. Training programmes may include swimming, cycling, running, strength training and related endurance sport activities.
The Coach may also provide general lifestyle, recovery and training-related guidance that is intended to support athletic development. Such guidance does not constitute medical, nutritional or therapeutic advice.
The Coach will review the Client’s progress on a regular basis and may adjust the programme accordingly. Any material changes will be discussed with the Client.
1.2 Scope of Practice and Referral
The Coach operates within the scope of their qualifications. Where coaching services are delivered by Alex Birch, these include British Triathlon Level 2 Coach, British Cycling Level 2 Ride Leader and Level 3 Personal Trainer. Any additional coach appointed by Triforia will hold appropriate and relevant qualifications for the services they provide.
Where the Coach believes it is in the Client’s best interests, the Client may be advised to seek guidance from an appropriately qualified medical or healthcare professional.
1.3 Confidentiality and Data Protection
All personal and medical information provided by the Client will be treated as confidential and handled in accordance with UK GDPR and applicable data protection legislation. Information will be used solely for the purpose of delivering coaching services and will not be shared with third parties without consent, unless
legally required.
2. Client’s responsibilities
2.1 Disclosure of information
Prior to commencing coaching, the Client must complete a Physical Activity Readiness Questionnaire (PAR-Q) and disclose all relevant medical, physical and mental health information, including injuries, conditions, allergies and medications. The Client has an ongoing obligation to inform the Coach of any changes to their
health or circumstances that may affect training.
Where appropriate, the Client may be required to obtain medical clearance before participating in training activities. Failure to disclose relevant information may increase the risk of injury and may result in suspension or termination of coaching services.
2.2 Fitness Testing
The Client may be asked to complete fitness assessments to establish appropriate training zones. These tests must be undertaken honestly, within the Client’s capabilities and with due regard for safety. Any concerns regarding test execution should be raised with the Coach in advance.
2.3 Safe Participation and Assumption of Risk
The Client is responsible for conducting all prescribed training sessions in a safe manner, selecting appropriate venues, wearing suitable clothing and using equipment that is in good working order. If the Client is unsure about any aspect of a session, they must seek clarification before proceeding.
The Client acknowledges that endurance sports training involves inherent risks, including but not limited to physical exertion, fatigue, environmental hazards and the possibility of injury. Depending on the Coaching Services selected, risks may include open water or pool swimming hazards, cycling on public roads or shared paths, running on varied or uneven terrain, adverse weather conditions, traffic, and the
actions of third parties.
The Client voluntarily accepts these risks and agrees to take reasonable responsibility for their own safety during all training activities.
3. Communication and Commitment
Coaching outcomes depend on consistent communication, engagement and effort from both parties. While the Coach will provide guidance, structure and support, the Client accepts responsibility for implementing the programme and making informed decisions during training.
The Client agrees to keep the Coach informed of any issues that may affect training adherence, performance or safety.
4. Coaching Terms and Conditions
4.1 Coaching Engagement
Coaching services are provided on an ongoing, week-to-week basis for a monthly fee. Services may be delivered by Alex Birch personally or by another suitably qualified coach authorised by Triforia. All services remain subject to this Agreement. Services commence once this Agreement has been accepted and signed by both parties.
4.2 Minimum Term
Unless otherwise agreed in writing, coaching is provided for a minimum period of three (3) months. Following completion of the minimum term, the Agreement will roll until cancelled by either party in accordance with
Section 4.4.
4.3 Fees and Payment
Monthly coaching fees are payable in advance by standing order on the agreed date. If payment is not received, the Coach reserves the right to suspend services until payment is brought up to date.
4.4 Cancellation and Termination
Following the minimum term, either party may terminate this Agreement by providing one (1) month’s written notice via email.
The Coach reserves the right to terminate or suspend coaching services if:

fees remain unpaid;

the Client fails to disclose relevant medical information;

the Client behaves in a manner that is unsafe, abusive or inappropriate;

the Coach reasonably believes that continued training presents an unacceptable risk to the Client’s health or safety.
5. One-to-One Training Sessions
One-to-one training sessions are not included in the monthly coaching fee and are charged separately. Sessions must be paid for in advance.
5.1 Coach Cancellation or Delay
If the Coach cancels a session with more than 24 hours’ notice, it will be rescheduled. If cancellation occurs within 24 hours, a replacement session will be arranged at no additional cost.
If the Coach arrives late, the session will be extended or made up at a later date, subject to availability.
5.2 Client Cancellation or Delay
If the Client cancels a session with less than 24 hours’ notice or fails to attend, the full session fee remains payable. If the Client arrives late, the session may be shortened due to prior commitments.
6. Limitation of Liability
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence where such liability cannot be excluded under UK law.
Subject to the above, the Coach shall not be liable for:

indirect or consequential loss;

loss of earnings, profits or anticipated performance;

missed competitions or events.
The Coach’s total liability arising under this Agreement shall not exceed the total fees paid by the Client in the three (3) months preceding any claim.
7. Intellectual Property
All training plans, materials, content and resources provided by the Coach remain the intellectual property of Triforia and are for the Client’s personal use only. They may not be shared, copied or distributed without prior written consent.
8. Force Majeure
The Coach shall not be liable for failure or delay in providing services due to events beyond reasonable control, including but not limited to severe weather, illness, public emergencies, pandemics, power or internet failure.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
10. Waiver and Acknowledgement of Risk
The Client confirms that they have a sufficient level of fitness to participate in the Coaching Services selected and have not been advised otherwise by a qualified medical professional.
The Client acknowledges that swimming (pool and open water), cycling and running are potentially hazardous activities and may take place in uncontrolled environments. Risks may include, but are not limited to, slips, falls, collisions, drowning, contact with vehicles or other road users, adverse weather conditions, water conditions, equipment failure and physical exertion.
The Client voluntarily assumes all inherent risks associated with participation in the Coaching Services selected.
